Temporary Skill Shortage visa (Subclass 482)

The Temporary Skill Shortage Sc 482 visa is a temporary work visa designed to provide Australian employers with an opportunity to fill vacancies with overseas skilled workers if an adequately skilled Australian citizens or permanent residents cannot be sourced for the role offered.

Temporary Skill Shortage visa (Subclass 482)

Subclass 482 also known as the TSS Visa (Temporary Skill Shortage) is a temporary work visa designed to provide Australian employers with an opportunity to fill vacancies with overseas skilled workers if an adequately skilled Australian citizens or permanent residents cannot be sourced for the role offered.

You may be eligible for Sc 482 visa if you have an offer of employment from an Australian employer who is prepared to sponsor you and provided you meet the criteria under the stream you will be applying under.

There are 3 streams available under Sc 482 visa

Short-Term Stream

The Subclass 482 visa (Short stream) allows stay for up to two years but can be extended for further 2 years. The extension process will require new employer nomination and new visa applications. In addition to the general criteria (see below) of the Sc482 visa, the Short-Term stream requires your nominated occupation to be included in the Short-Term Skilled Occupations List, achieve a specific result in one of the recognised English tests (overall band score of at least 5.0 with a score of at least 4.5 in each of the test components if opting for ILETS test), unless exempt and meet Genuine Temporary Entrant (GTE) requirement.

Medium-Term Stream

The Subclass 482 visa (Medium stream) allows stay for up to four years and unlike the short-term stream, the medium-term stream does provide a pathway to residence. In addition to the general criteria (see below) of the Sc482 visa, the medium-Term stream also requires your nominated occupation to be included in the Medium Long-Term Strategic Skills List and achieve a specific result in one of the recognised English tests (overall band score of at least 5.0 with a score of at least 5 in each of the test components), unless exempt.

Labour Agreement Stream

This stream was designed to assist Australian employers to address specific skills shortages as negotiated in a labour agreement with the Commonwealth where standard visa programs are not available. The Subclass 482 visa (Labour agreement stream) allows stay for up to four years and may lead to residence. In addition to some of the general criteria (see below) of the Sc482 visa, the labour agreement stream requires that the sponsoring employer holds an agreement with DHA to hire overseas personnel and that any requirements as specified in the labour agreement, in terms of age, occupation, skills, English level and remuneration have been met.

There are the five categories of labour agreements:

  • company-specific
  • industry - specific
  • designated area migration agreements (DAMA)
  • project agreements
  • Global Talent Employer Sponsored (GTES) agreements

What is the process?

In order to be eligible for this visa, the applicant must have an offer of employment from an Australian employer who is prepared to sponsor you and provided you meet the criteria under the stream you will be applying under.

The Sc 482 visa is a three-stage process

  • Stage 1 - a sponsorship application submitted by the employer – it provides the details of the business seeking to employ an overseas worker
  • Stage 2 - a nomination application submitted by the employer – it provides the details of the position to be filled as well as identifies the overseas worker and any secondary applicants covered by the nomination
  • Stage 3 - a visa application submitted by the employee – it provides the details of how the overseas worker is skilled for the nominated occupation as well as personal details of the principal applicant and any secondary applicant/s included in the application.

All three applications can be submitted at the same time, i.e the employer does not have to wait for the Sponsorship application to be approved before submitting a Nomination application; similarly the employee does not have to wait for the Sponsorship and/or Nomination application to be approved before submitting a visa application.
